1Introduction
1.1About Us
These Consumer Terms of Service ("Terms") govern your use of (i) the HaloRoam mobile application (both iOS and Android versions) and (ii) eSIM data plans ("Data Plans"), collectively the "Services". These Terms apply only to users using the Services for personal (non-commercial) purposes.
1.2Operator
The Services are operated by Tapcom Technology Limited (觸通科技有限公司), a body corporate registered in the Hong Kong Special Administrative Region (Business Registration No. 70308547; certificate no. 70308547-000-01-26-9), with its business address at Unit 1140B, 11/F, Eastcore, 398 Kwun Tong Road, Kwun Tong, Kowloon, Hong Kong ("HaloRoam", "we", "us"). Contact: [email protected] · https://haloroam.net. The business registration is valid until 16 January 2027 and this table will be updated upon renewal.
1.3Updates
We may amend these Terms to comply with legal requirements, to add features or to improve the Services. We will publish the amended Terms in the app and update the "last updated" date at the top. Material changes will be notified in advance through an in-app notice or email. If you do not agree, please stop using the Services and you may terminate under Section 10. Your continued use of the Services after a change takes effect constitutes acceptance of the amended Terms.
1.4Age
You must be at least 18 years old and have full legal capacity to enter into, comply with and perform these Terms.
1.5Binding Agreement
These Terms constitute a binding legal agreement between you and HaloRoam. By registering an account, using the app or purchasing the Services, you confirm that you have read and agree to these Terms.
1.6Privacy
For information on how we collect and process your personal data, please read the Privacy Policy (https://haloroam.net/privacy). That policy forms part of these Terms.
2Services
2.1Data Plans
We provide an eSIM with a data plan based on the functionality of the eSIM provided. The data allowance, validity period, fair-use/throttling rules and applicable regions are as displayed on the purchase page and in the plan description.
2.2Availability
We reserve the right to restrict the availability of the Services in certain regions or destinations. You may browse, select and purchase the Services in the app.
3General Terms
3.1Registration
(a) You may create an account and use the Services through the app, by signing in with a third-party account (see 3.1.2). (b) Registration requires you to provide the necessary information through a third-party sign-in (such as your name and email address): the iOS version uses Sign in with Apple; the Android version uses Google Sign-In. The available sign-in methods on each platform are as shown in the app. (c) You are fully responsible for all use of and activity under your account and must keep your account credentials secure.
3.2Device Requirements
Before purchasing, you must have a carrier-unlocked device that supports eSIM. Both the iOS and Android versions require a device that supports eSIM; the system requirement is iOS 16.0 or later (for Android, the requirements stated on the app store listing apply). The exact system requirements and supported device models are as stated on the app store listing and in the app. Inability to use the Services because your device does not support eSIM, is locked, or does not meet the system requirements is not a ground for a refund (however, orders with no usage may still be refunded under Section 4).
3.3Downloading & Installing the eSIM
After purchase, you need to install the eSIM on your device in order to use the Data Plan as configured by your order. Installation differs by platform: on iOS the system eSIM installation flow can be invoked directly; on Android you generally scan a QR code or enter the activation details manually in system settings (some devices also support one-tap installation). Even after the Data Plan expires or its data is used up, the downloaded eSIM remains on your device and you may remove it at any time. Removing the eSIM from your device does not affect your account, purchased Data Plans or order history.
3.4Activation & Validity
(a) The activation window of a Data Plan (the period during which it may be started after purchase) is as stated in the plan description. (b) The validity period starts when the eSIM is first installed on your device or first connects to a network, whichever occurs first, as further determined by the plan description and our supplier's rules. (c) If you do not activate within the activation window stated in the plan description, the Data Plan may no longer be usable or may be handled according to our supplier's rules; refunds remain subject to the window and conditions in Section 4.
3.5Payment Methods
(a) Card payments are processed by Stripe (Stripe Payment Sheet on iOS; the platform's corresponding payment flow on Android) and support credit/debit cards; Apple Pay (iOS) and Google Pay (Android) are additionally available on supported platforms. (b) Credit balance payments use the credit balance in your account; this method is unavailable if the balance is insufficient. (c) After a successful payment you will receive a receipt email and can view your billing and order history in the app. (d) In-app store purchases (where applicable): if a platform requires settlement through its app store (for example Google Play Billing), purchases on that platform will be processed by that store and its terms will apply; where the platform does not require this, card and Google Pay payments are processed directly by Stripe. The actual channel shown in the app and used for the charge prevails.
3.6App Store Terms
If you obtain the app through the Apple App Store, Google Play or another store, that store's own terms and policies also apply. In case of conflict regarding distribution or store billing, the store's terms prevail.
4Refund Policy
4.1Eligibility
You may request a refund for an order if you submit the request within 7 calendar days of purchase and the Data Plan has generated no usage at all (including plans that were never installed, or installed but never connected to a network).
4.2Non-refundable Cases
No refund will be given where: (i) the Data Plan has generated any usage (including connecting to a network and using data); (ii) the Data Plan has expired; (iii) there are indications of abuse or fraud; (iv) the account has been deleted; or (v) the 7-calendar-day window in clause 4.1 has passed.
4.3Where Refunds Go
Order refunds are always credited to your credit balance (not directly to the original payment method). The refunded amount equals the amount actually paid for the order. To have credit returned to the original payment method, you must submit a separate request under clause 6.4.
4.4Processing & Timelines
(a) Order refunds (order → credit): we will complete our review within 5 business days of receiving an eligible request; once approved, the amount is credited to your credit balance immediately. (b) Credit to original payment method (credit → original card): this requires manual review; once approved, the amount is returned to the original payment method within 1–5 business days, with actual arrival time depending on the payment channel (see clause 6.4). (c) Refund eligibility is ultimately determined by our supplier's API; if the supplier refuses to void the eSIM (for example because the eSIM is installed or has generated usage), we cannot complete the refund.
4.5Refund Fees
(a) Refunds from an order to your credit balance are free of charge. (b) A refund from credit to your original payment method may incur a handling fee (payment-channel or manual-processing costs), which will be deducted from the refunded amount and shown in the refund details.
4.6Top-Up Refunds
(a) If a Top-Up payment succeeds but the supplier fails to place the order (status: failed), you may request a refund to your credit balance. (b) When the eSIM of the main Data Plan is voided and refunded, any active Top-Ups on that eSIM are voided and refunded together with it, with no separate request required from you. (c) Apart from the above, active Top-Ups are non-refundable.
4.7Requests Cannot Be Withdrawn
A refund request submitted under clause 6.4 cannot be withdrawn by the user; only we may reject it. If rejected, the relevant amount is returned to your credit balance.
5Service Provision
5.1Start of Service
The Services begin when the Data Plan's validity period starts (see clause 3.4.2); before that, you may already download and install the eSIM.
5.2End of Service
The Services end when the Data Plan's data is used up or its validity period expires, whichever occurs first. After that, the eSIM remains on your device and you may remove it yourself.
5.3Service Quality
The Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted or error-free, nor that any particular speed will be available at any location or time. Actual speed and coverage depend on the local carrier network, your location, your device capabilities and network congestion.
5.4Fair Use & Throttling
(a) Some Data Plans are throttled once the data allowance is used up (speed reduced but not disconnected) or are otherwise rate-limited; see the plan description. (b) You must not use the Services for abnormal or abusive purposes (for example resale, bulk sharing, automated scraping, or behaviour that places an unreasonable load on the network). We reserve the right to throttle, suspend or terminate the Services for such behaviour. (c) Whether hotspot/tethering is available depends on the Data Plan and the local carrier's policy; see the plan description.
5.5Measurement & Billing Units
Your data usage is measured by rounding each session up to the nearest 1KB; measurement is based on our supplier's records.
6Credits, Coupons & Refund to Original Payment Method
6.1Credit Balance
The credit balance is a wallet-style balance used to offset purchases; it persists across sessions. Credit originates from refunds and from coupon redemption.
6.2Coupons
A coupon is a single-use redemption code (where this feature is offered in the app). Once redeemed, the amount is credited to your credit balance; redemption cannot be reversed and the code cannot be reused.
6.3Restrictions
(i) Credit cannot be transferred to other users; (ii) negative balances are not supported; (iii) credit is not legal tender and does not bear interest.
6.4Refund to Original Payment Method
(a) Credit originating from card payments (Stripe) that has been refunded into your balance may be refunded back to the original payment method; the eligible amount is shown on the Transactions page. (b) Requests are for the full eligible amount, cannot be partially specified, only one request may be in progress at a time, and cannot be withdrawn by the user once submitted (we may reject it, in which case the amount returns to your credit). (c) Manual review is required (we will complete the review within 5 business days of receiving the request); after approval the refund reaches your original payment method within 1–5 business days. (d) A handling fee may apply and is deducted from the refunded amount (see 4.5). (e) If the original payment method is no longer valid, the amount returns to your credit. (f) Only card-payment refunds credited within the last 180 days are eligible.
7User Responsibilities
7.1Fair Use
You agree to use the Services only for personal purposes and not for commercial use, resale or redistribution.
7.2Prohibited Conduct
You must not: (i) use the Services for any unlawful activity; (ii) reverse engineer or attempt to access the underlying systems of the Services; (iii) abuse the Services or impair other users' experience; or (iv) access or attempt to access other users' data without authorisation.
7.3Content Responsibility
You are fully responsible for the content you transmit while using the Services. We do not monitor content transmitted by users, but we reserve the right to act if we become aware of unlawful activity.
8Intellectual Property
8.1Ownership
The intellectual property rights in the app, the website and related content (including but not limited to text, graphics, logos, interface design and code) belong to HaloRoam or its licensors.
8.2Licence
Provided you comply with these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the app for your personal, non-commercial use.
8.3Prohibited Conduct
You must not: (i) copy, modify or distribute any part of the app; (ii) remove or alter any copyright, trademark or other rights notice; or (iii) use the app for commercial purposes without our express written authorisation.
9Disclaimer & Liability
9.1As-is Basis
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.
9.2Limitation of Liability
To the maximum extent permitted by applicable law, HaloRoam is not liable for: (i) indirect, incidental, special or consequential damages; (ii) losses caused by interruption or unavailability of the Services; or (iii) loss or corruption of data.
9.3Cap on Liability
HaloRoam's total liability to you shall not exceed the amount you actually paid to us in the 12 months preceding the event giving rise to the claim.
9.4Consumer Rights
Nothing in these Terms excludes or limits any statutory rights you have under applicable consumer protection law that cannot be excluded by contract. Where these Terms conflict with mandatory consumer protection rules in your place of residence, those rules prevail.
10Termination
10.1Termination by You
You may stop using the Services at any time by deleting the app, removing the eSIM from your device, or using "Account → Delete Account" in the app. Accounts are independent per platform: deleting your account deletes only the account on the platform you are using; if you also registered on the other platform, you must delete that account separately. If you cannot use the in-app option (for example if you have uninstalled the app), you may email [email protected] (with the subject "Account Deletion") to request deletion; we will handle it after verifying your identity. After your account is deleted, we will process your personal data in accordance with the Privacy Policy.
10.2Termination by Us
If you breach these Terms, we reserve the right to suspend or terminate your account and the Services.
10.3Consequences of Termination
After termination: (i) your account will be deactivated and you will no longer be able to view or manage orders and Data Plans in the app; (ii) where you terminate (for example by deleting your account), an installed eSIM may still be usable on the original device until the Data Plan's validity period expires — such use does not depend on signing in to the app and is subject to our supplier's rules; unused portions are not separately refunded; where we terminate because you breached these Terms, we may also stop the relevant Services; and (iii) the provisions of these Terms concerning intellectual property, disclaimers and limitation of liability survive termination.
11Governing Law & Disputes
11.1Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (the contracting entity's place of registration, see clause 1.2), without prejudice to mandatory consumer protection rules in your place of residence.
11.2Dispute Resolution
Disputes arising out of or in connection with these Terms or the Services shall first be resolved through good-faith negotiation (you may contact [email protected]). Failing that, disputes shall be submitted to the competent courts of the Hong Kong Special Administrative Region. If you are a consumer, you may also bring proceedings before the competent courts of your place of residence.
12Other Provisions
12.1Indemnity
You agree to indemnify and hold us harmless, to the extent permitted by applicable law, against losses, liabilities, fines and reasonable costs (including reasonable legal fees) arising from third-party claims resulting from (i) your breach of these Terms, (ii) your unlawful or abusive use of the Services, or (iii) your infringement of third-party rights. We will notify you of such claims in a timely manner and may choose how to respond, including settlement. This clause does not apply to losses caused by our own fault and does not exclude or limit your rights under mandatory consumer protection law.
12.2Force Majeure
We are not liable for interruption, delay or failure to perform caused by events beyond our reasonable control. Such events include but are not limited to natural disasters, war, terrorism, epidemics, governmental or regulatory action, changes in law, network outages of carriers or upstream suppliers, failure of power or internet infrastructure, and third-party service failures. The affected party shall notify the other within a reasonable time and use reasonable efforts to mitigate the impact.
12.3Severability
If any provision of these Terms is held invalid, illegal or unenforceable by a court or regulator of competent jurisdiction, that provision will be narrowed or deleted to the minimum extent necessary to achieve its purpose, and the remaining provisions remain in full force.
12.4Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to our affiliates, or to a successor in a merger, acquisition, reorganisation or asset transfer, without your consent; such assignment does not affect your rights under these Terms or under mandatory consumer protection rules.
12.5Entire Agreement
These Terms, together with the Privacy Policy and any rules expressly referenced in the app or at purchase (such as specific plan descriptions and limits), constitute the entire agreement between you and us regarding the Services and supersede any prior oral or written understandings on the same subject. However, the order details confirmed at purchase (plan, price, validity period) are not diminished by these Terms.

Appendix: Platform Differences (iOS / Android)
Accounts are independent and are not shared between the two platforms (the iOS version uses Sign in with Apple, the Android version uses Google Sign-In); orders and credit are managed separately per platform. In addition, the following differ due to system capabilities: System requirements — iOS: device must support eSIM, iOS 16.0 or later; Android: device must support eSIM, system version per the app store listing. Third-party sign-in — iOS: Sign in with Apple; Android: Google Sign-In. eSIM installation — iOS: system eSIM installation flow / QR scan; Android: scan a QR code or enter activation details manually (some devices support one-tap installation). Payment — iOS: Stripe Payment Sheet (card / Apple Pay); Android: Stripe (card / Google Pay), or app-store billing where the platform requires it. Account deletion — iOS: "Account → Delete Account" in the app; Android: same in-app option, or email [email protected] if the in-app option is unavailable.
Terms not listed in this table apply equally to both platforms. If a feature is offered on only one platform, the in-app presentation prevails and no commitment is made for the other platform.
